A LENGTHY legal battle centred on a port is finally over.

Three Court of Appeal judges have dismissed an appeal by Mistley Port owners TW Logistics, which contested a conservation document.

The business disputed Tendring Council’s Conservation Area Management Plan (CAMP) saying it was not consistent with the Local Plan and was therefore unlawful.

The CAMP, which was adopted in August 2010, provides guidance and recommendations on how the Manningtree and Mistley Conservation Area should be managed. It is referred to when determination of planning applications for development in that area.

TW Logistics first launched the legal battle in 2010.

Tendring’s planning portfolio holder Carlo Guglielmi, said: “We are very pleased that the courts have decided that this document does not infringe on or conflict with the Local Plan.

“We can now look forward to the Manningtree and Mistley Conservation Area Management Plan being used to help guide priorities for the area.”
